Booking and Payment

To secure your date with me, I require a signed photography contract along with a 30% non-refundable retainer. This retainer is credited toward your total package fee, so it is not an additional cost — it simply reserves your date on my calendar.

The remaining balance is due 30 days before your event. I understand that life gets busy leading up to a big day, so I will send you a reminder as your due date approaches.

Please note that a late fee of $5 per day applies to overdue balances. I am unable to deliver your images until all balances are resolved — I want to get your photos to you as quickly as possible, so timely payment helps us both.

Cancellation and Rescheduling

I understand that life happens and plans sometimes change. Here is how cancellations are handled based on timing:

• 90+ days before your event: Your retainer is forfeited, but any additional payments will be refunded
• 30–89 days before your event: 50% of the total fee is forfeited
• Less than 30 days before your event: 100% of the total fee is forfeited

If you need to reschedule rather than cancel, I offer one free reschedule as long as you give me at least 90 days' notice. The new date must fall within 12 months of your original event date and is subject to my availability.

In the unlikely event that I need to cancel, I will make every effort to find a qualified replacement photographer for you. If a suitable replacement cannot be found, you will receive a full refund within 15 business days.

Delivery and Gallery Access

Your edited images will be delivered within 6 to 8 weeks of your session or event date. I know the wait can feel long, but I take great care with every image to make sure your gallery is something truly special.

Once delivered, your online gallery will remain active for 120 days (approximately 4 months). I will send you reminder emails before your gallery expires so you have plenty of time to download everything. Please be sure to download your images within this window — I am not required to maintain copies beyond 14 days after gallery expiration.

If you need more time, gallery access can be re-published for an additional 120 days at a fee of $75.

Your gallery also includes 10 complimentary re-edits — if there are any small adjustments you would like, just let me know within 14 days of delivery and I am happy to take care of them.

What You Will Receive

Your gallery will include high-resolution, professionally edited JPEG images ready for printing, sharing, and cherishing for years to come.

Please note that RAW files, unedited images, and outtakes are not included in any package. Every image I deliver has been carefully culled and edited to reflect my artistic vision and ensure your gallery tells a beautiful, cohesive story.

Copyright and Image Usage

Under United States copyright law (Title 17), I retain full copyright ownership of all photographs I create. When you book with me, you receive a personal-use license that allows you to enjoy your images in many wonderful ways:

• Sharing on social media (I would love a tag @luisancphotography!)
• Ordering prints and albums
• Creating holiday cards and personal gifts

To protect the integrity of your images, the following uses are not permitted:

• Commercial use of any kind
• Applying filters or cropping out watermarks
• Submitting to contests or publications without written permission
• Uploading to AI or machine-learning platforms
• Reselling or redistributing images

I may use images from your session in my portfolio and marketing materials. If there are specific images you would prefer I not share publicly, just let me know and I will happily respect your wishes.

Limitation of Liability

I will always do my very best to deliver an incredible experience and beautiful images. However, my total liability for any claim related to my services is limited to the total fees you have paid.

In the unlikely event of extraordinary circumstances beyond either of our control — such as a natural disaster, severe weather, or other unforeseen situations — we will work together to reschedule your session within 12 months. If rescheduling is not possible, you will receive a refund of all fees paid minus the retainer and any expenses already incurred, issued within 15 business days.

Overtime

If your event is flowing beautifully and you would like me to stay beyond the hours included in your package, I am happy to do so! Overtime is billed at $350 per hour, per photographer, in one-hour increments.

Overtime must be verbally approved on the day of your event — I will always check with you before extending coverage so there are no surprises.
